Topics
UP Connection: UP के urban areas (Lucknow, Kanpur) में secularism और socialism के implementation को देखते हुए आप answer में UP के communal harmony programs का mention कर सकते हैं।
Fundamental Rights (Part III): Article 12-35
| Right | Article | Key Points | UP Example |
|---|---|---|---|
| Right to Equality | 14-18 | No discrimination, equal protection, abolition of untouchability | UP में dalit students के लिए scholarship schemes |
| Right to Freedom | 19-22 | Speech, assembly, movement, profession, petition | UP में student protests और press freedom cases |
| Right Against Exploitation | 23-24 | Prohibition of traffic in human beings, forced labor | UP में human trafficking cases और NGO work |
| Right to Freedom of Religion | 25-28 | Freedom to practice, propagate, manage religious affairs | UP में communal riots और religious freedom issues |
| Cultural and Educational Rights | 29-30 | Minorities’ right to establish and manage educational institutions | UP में minority schools और madarsa education |
| Right to Constitutional Remedies | 32 | Right to move Supreme Court for enforcement of rights | UP residents की PIL petitions (Lucknow pollution case) |
Directive Principles of State Policy (DPSP) – Part IV
Key DPSP Articles:
- Article 38: Social order based on justice और equality
- Article 39: Right to work, equal pay, child welfare
- Article 45: Free and compulsory education (specific age limits के लिए official UPPSC notification देखें)
- Article 48: Protection of cows (UP में बहुत relevant है)
UP Connection: UP government के “Anganwadi” और “Mid-Day Meal Scheme” DPSP को implement करते हैं।
Fundamental Duties (Part IVA) – Article 51A
Fundamental Duties: Constitution को respect करना, national anthem respect, राष्ट्रीय symbols को protect करना, sovereignty defend करना, common good के लिए काम करना, scientific temper develop करना, environment protect करना, cultural heritage preserve करना, public property protect करना, और peaceful resolution में help करना।
Kesavananda Bharati v. State of Kerala (1973) – Turning Point
Basic Features (जो amend नहीं हो सकते):
- Supremacy of Constitution
- Democratic form of government
- Secular character
- Federalism
- Separation of powers
- Judicial review
Important Cases Quick Reference
- Kesavananda Bharati (1973): Basic Structure Doctrine established
- S.R. Bommai (1994): Secularism को basic feature माना
- Indra Sawhney (1992): Creamy layer concept introduce किया (OBC reservation के लिए)
Federalism और Centre-State Relations – UP के संदर्भ में
Three Pillars
| Pillar | Meaning | UP Example |
|---|---|---|
| Division of Powers | Union List (97 items), State List (66 items), Concurrent List (47 items) | Education, agriculture, police—UP के लिए state list items |
| Supremacy of Constitution | Constitution ही सभी powers का source है | UP Vidhan Sabha की कोई भी law Constitution के against नहीं हो सकती |
| Rigidity | Amendment के लिए special procedure (2/3 majority) | UP को अपना separate constitution नहीं बना सकते |
UP-Specific Centre-State Issues
State Legislature – UP Vidhan Sabha की विशेषताएं
UP Vidhan Sabha के लिए specific knowledge जरूरी है।
UP Vidhan Sabha: Key Facts
- Total Members: 403 (402 elected + 1 nominated)
- Bicameral Legislature: UP के पास Vidhan Sabha (Lower House) और Vidhan Parishad (Upper House) दोनों हैं
- Vidhan Parishad Members: 100 members (राज्यपाल द्वारा nominated, elected, या co-opted)
- Term: 5 साल
- Chief Minister: Vidhan Sabha का leader
UP Vidhan Sabha की Powers और Functions
UP Vidhan Sabha
- State के लिए laws बना सकता है (State List और Concurrent List items पर)
Exam Angle: “UP Vidhan Sabha की legislative powers में क्या limitations हैं?”
UP-Specific Mechanisms
Modern governance transparency और accountability पर based है।
Right to Information (RTI) Act 2005
Key Points:
- UP का अपना State Information Commission है
UP Example: UP के किसी भी government office से आप RTI के through information मांग सकते हैं। Exam में आप लिख सकते हैं: “UP में Lucknow Municipal Corporation के corruption cases को RTI के through expose किया गया था।”
Lokayukta (Ombudsman)
UP Lokayukta की Powers:
- Preliminary investigation
Recent UP Case: UP Lokayukta
RTI vs Lokayukta:
UP Panchayati Raj और Urban Local Bodies – परीक्षा के लिए Critical Notes
UP Panchayati Raj Act 1994
UP में Panchayati Raj 3-tier system है:
| Level | Name | Jurisdiction | Members |
|---|---|---|---|
| Village | Gram Panchayat | One or more villages | 5-15 members (population के according) |
| Block | Block Panchayat (या Kshetra Panchayat) | Multiple Gram Panchayats | Usually 15-30 members |
| District | District Panchayat (या Zilla Parishad) | Entire district | Usually 30-50 members |
UP Panchayati Raj की Key Features
1. Reservation System:
- Women: 33% seats reserved (73rd Amendment के according)
- SC/ST: Population proportion के according
- OBC: UP में OBC reservation भी है (state-specific)
2. Finance: Panchayats को अपना revenue source है (property tax, water charges) लेकिन state से भी grants मिलते हैं।
Exam Answer Example (15-mark):
“UP Panchayati Raj 1994 Act के तहत, 3-tier system village से district level तक democratic governance ensure करता है।
UP Urban Local Bodies (Municipalities)
(Lucknow, Kanpur, Varanasi)
- Municipal Board (Nagar Palika Parishad): Medium cities
UP के Governor (राज्यपाल)
UP के Chief Minister (मुख्यमंत्री)
- Council of Ministers को form करता है
