How is this topic framed for UPPSC GS-V?

This topic sits in the GS-V paper on Uttar Pradesh and covers public services, the Public Service Commission, audit, the Advocate General and the High Court with its jurisdiction. Questions usually test the constitutional base first and the Uttar Pradesh working second.

  • Learn the Article numbers and the one-line role of each institution.
  • Link every institution to Uttar Pradesh: the High Court at Prayagraj, the Accountant General office at Prayagraj and the State Legislature.
  • Use the answer in three layers: constitutional provision, how it works in Uttar Pradesh, and one reform or accountability point.
  • Keep exact status words: the Advocate General advises, the High Court decides, the auditor reports.

This page covers the High Court, the Advocate General and audit. The Public Service Commission has its own page.

What is the constitutional framework?

Three separate parts of the Constitution create these institutions. The Union and State audit rules sit in the chapter on the Comptroller and Auditor-General, the Advocate General sits with the State Executive, and the High Court sits in the chapter on the Judiciary in the States.

Constitutional provisions behind the three institutions
Institution Article What the Article provides
Comptroller and Auditor-General 150 Form of accounts of the Union and States
Advocate General 165 Advocate-General for the State
High Court 214 High Courts for States
High Court 215 High Courts to be courts of record
High Court 226 Power to issue certain writs
High Court 227 Superintendence over all courts
High Court 231 Common High Court for two or more States

Articles 233, 234 and 235 deal with district judges, recruitment to the judicial service and control over subordinate courts. They show that the High Court is not only a court of appeal but also the supervising body of the State judiciary.

How do the High Court and the Advocate General work in Uttar Pradesh?

Article 214 provides a High Court for each State, and the Allahabad High Court is the High Court for Uttar Pradesh. Article 215 makes every High Court a court of record, so its records and decisions have evidentiary value and it can punish for its own contempt.

Two Articles define its everyday power. Article 226 gives the power to issue certain writs, which is the route by which citizens challenge state action. Article 227 gives the power of superintendence over all courts within its territory.

  1. Citizen or officer moves the High Court
  2. Petition under Article 226
  3. Court examines state action
  4. Orders or directions issued
  5. Appeal on the legal question
  • Article 231 allows a common High Court for two or more States, though Uttar Pradesh has its own.
  • Article 235 gives the High Court control over subordinate courts, which links it to every district court in the State.

The Advocate General is the State's counsel in these courts.

The Advocate-General for the State is a constitutional office under Article 165. The office-holder is the highest law officer of the State Government and appears for the State in the High Court and other courts.

For Uttar Pradesh, which has both a Legislative Assembly and a Legislative Council, the right applies to both Houses.

Advocate General compared with other State law offices
Feature Advocate General High Court
Constitutional basis Article 165 Article 214
Core role Legal adviser and counsel of the State Adjudicates and supervises courts
Accountability Answerable to the State Government Independent judiciary

A writ petition under Article 226 is a direct constitutional remedy and is different from an ordinary appeal. The petitioner asks the High Court to examine whether State action is lawful, and the State is usually represented by its law officers.

Together they show a balance: the State Government defends its decisions, and the High Court can review them.

How does audit work for Uttar Pradesh?

The Comptroller and Auditor-General of India is appointed by the President by warrant and can be removed only in the same manner and on the same grounds as a Judge of the Supreme Court. The CAG is not eligible for further office under the Government of India or any State after leaving office.

Article 150 says accounts of the Union and of the States are kept in the form the President prescribes on the advice of the CAG.

  1. State departments spend from the Consolidated Fund
  2. Treasuries send accounts
  3. Accountant General prepares State accounts
  4. CAG report goes to the Governor
  5. Governor lays it before the Legislature

Articles 243J and 243Z also provide for audit of the accounts of Panchayats and of Municipalities, which extends audit logic to local government.

  • Audit checks that money was spent for the purpose voted by the Legislature.
  • The audit report is a tool of legislative control over the executive, since the Legislature sees it only through the Governor.

What is the Uttar Pradesh angle?

Uttar Pradesh has its own High Court, its own Advocate General and an Accountant General office whose accounts and entitlement branch sits at Prayagraj. The office keeps the State Government accounts on inputs from State Treasuries and prepares the Appropriation and Finance Accounts. It also keeps works accounts of the Public Works Department, Minor Irrigation and Rural Engineering Services and compiles accounts of the Forest Divisions.

For a GS-V answer, tie each institution to a State working: the High Court for writs against State action, the Advocate General for State litigation and Legislature rights, and the Accountant General for the accounts laid before the State Legislature through the Governor.

Which examples can be used in answers?

  • Article 226 writs as the citizen's route against State action in Uttar Pradesh.
  • Article 235 control of the High Court over subordinate courts in the districts of the State.
  • The Accountant General Uttar Pradesh, named from 30 January 1950, preparing Appropriation and Finance Accounts.
